The non-profit organization Sauve qui peut le court métrage (SQP) located at la Jetée, 6 place Miche-de-l'Hospital, 63058 Clermont-Ferrand proposes on the Website clermont-filmfest.org (the Site) the information, the documentation, and services, thematically distributed, concerning the artistic branch of the short film, and the annual short film festival, which is held in Clermont-Ferrand.
The Editor of the Site is Mr. Julien WESTERMANN (j.westermann@clermont-filmfest.org).

Access and use of the Site imply the tacit and unreserved acceptance of these Terms by the User, in their latest online version.
Access to the SQP Website is open to anyone wishing to learn about the artistic branch of the short film, and about the various products, services and events offered by SQP.
Only access to the "Pro Services" part, allowing access to the festival's database, is subject to the prior subscription of a paid subscription (see article).
Access to the Site is provided continuously and permanently, except in case of Force Majeure or events beyond the control of SQP, and subject to any breakdowns and maintenance required for the proper functioning of the Site.
Moreover, because of the very nature of the Internet, SQP can not guarantee the functioning of the Site 24 hours a day, 7 days a week.
SQP offers on the Site a service called Pro Services, allowing users who have previously subscribed, to access the database of short film festival organized by SQP in Clermont-Ferrand, and prepare their participation in the said festival.
2.1 Description of the Service
The AccèsPro subscription gives access to the following services:
- Access to the database of the Clermont-Ferrand Short Film Festival, including more than 40 000 short films and their detailed files.
The Subscriber can perform several multicriteria searches simultaneously, based on criteria such as the title, the director, the country of production, the duration, the original music ... The film and director's sheets include the film summary , the credits, the biography and the filmography of the director, information concerning the production, the sale of the film ...
- Access to the Short Film Professionals Guide, including contact information and profiles of individuals or companies involved in the sector.
- Possibility for Subscribers to create their address book online, to facilitate exchanges with industry professionals.
- Possibility for Subscribers to prepare, before the Festival, the screenings of his films at the Marché's video library, by creating his own lists of films, and by promoting them to Festival participants.
- Organize, through SQP, a schedule of meetings with Festival participants, and especially Buyers.
As such, SQP is obligated to provide resources in the organization of the meeting schedule, by implementing all the necessary means to ensure that the meeting requests made by the festival participants can be fulfilled.
However, it remains possible that the requests of the participants can not be crossed with the availability of the desired interlocutor.
In this case, SQP will inform the Subscriber of this unavailability, and will try to reach an alternative solution with no obligation of result.
SQP recalls that it plays no role in the discussions, and in the relationship that may be established between the Festival participants who will have come into contact with the event.
SQP does not guarantee the Subscriber the conclusion of any sale, agreement or transaction of any kind with Festival participants.
And other features in constant evolution, this list is not exhaustive.
2.2 Registration
Access to the AccèsPro Service is subject to the validation of the registration form available online, to the validation of these Terms of Use by the Subscriber, and to online payment of the amount of the subscription stipulated under the Article 2.4 hereof.
At the time of registration, the Subscriber undertakes to provide accurate and truthful information about his situation, as well as to carry out a regular verification of the data concerning him, and to proceed on line on his Private Area, the case the necessary modifications.
2.3 Personal identification elements
The subscription gives rise to the attribution of a confidential username and password, sent by email to the Subscriber, allowing him to access the AccèsPro Service, as well as his private area.
These identifiers are personal, confidential and non-transferable. Under these conditions, the Subscriber undertakes not to communicate them to third parties, and will ensure to raise the awareness of his staff possibly affected to the use of the Services, on the need to be particularly vigilant on the confidentiality of these elements of identification.
SQP can not, in any case, be held responsible for a fraudulent intrusion on the subscriber's private interface, in the context of the use of the AccèsPro Service.
2.4 Financial Conditions
- Rate
The price of the Accès Pro subscription is 60 € HT.
We reserve the right to change this price at any time but we agree to apply the rate indicated on the Site at the time of your order.
Without a valid VAT reference, subscribers located in the territory of the European Union will be subject to French VAT (19.6%).
For France, systematic application of VAT.
For third countries, no application of French VAT.
All subscriptions, regardless of the subscriber's address, are payable in euros exclusively.
Our invoices are payable in cash, without discount.
In accordance with Article L.441-6 of the Commercial Code, a late penalty equal to 3 times the legal interest rate in force will be applied.
Lump sum payment for recovery costs in case of late payment: 40 €

The payment of the subscription is made:

SQP strives to offer Users the most reliable and qualitative information available.
SQP does not guarantee, however, the accuracy and completeness of the information published on the Site.
SQP can not therefore be held responsible for any direct or indirect damage suffered by users or by third parties who find their source in the information published on the Site, and more generally, in the consultation and use of the Site .
SQP also does not monitor the sites linked to the Site by means of hypertext links, and declines all liability related to these sites and the content contained therein.
4.1 All data of any kind, including movies, text, graphics, logos, icons, images, audio or video clips, brands, software, appearing on the Site are necessarily protected by copyright, trademark law and all other intellectual property rights.
The data thus protected are the property of SQP or third parties having authorized SQP to exploit them. .
SQP, in its capacity as Publisher of the Site, grants the User a private, non-collective and non-exclusive right to use the said content.
The User undertakes in these conditions not to reproduce, summarize, modify, alter or redistribute, without prior express authorization of the Publisher, any films, images, audio or video clips, text, title, application, software, logo , brand, information or illustration, for a use other than strictly private, which excludes any representation for professional purposes or rebroadcast in number.
Similarly, the User agrees not to copy all or part of the site on another site or internal corporate network.
4.2 All the accessible data and contents published on the Site, as well as their consultation procedures, constitute the Database of the SQP Website.
This Database is protected by the provisions of the Intellectual Property Code relating to copyright, as well as by the provisions of the European Directive of March 11, 1996.
In these conditions, the User agrees to use this data in the strict context of the consultation of the Website, and prohibits in particular to reproduce, translate, adapt, arrange, transform, communicate, represent and distribute, permanently or by any means and in any form whatsoever all or part of the data contained in these databases, other than in the cases referred to in paragraph 4.1 of this article.
4.3 Any creation of a hypertext link from an Internet site to the Site must be expressly authorized by SQP.
In accordance with the provisions of the law n ° 78-17 of January 6, 1978 relating to data, files and freedoms, the Site has been the subject of a declaration to the CNIL (Commission Nationale Informatique et Libertés).
Users who have applied for membership of the proposed services have, according to the Law of January 6, 1978, a right of access to the data that concerns them, as well as a right to modify and delete them.

SQP retains the personal data of the Users on its own servers and undertakes to keep the personal data collected strictly confidential.
6.1 In the event that one of the provisions of these Conditions would be considered null under a legal or regulatory provision, present or future, or a court decision res judicata and emanating of a competent court or body, this provision of the contract would be considered as being unwritten, all the other provisions of these Terms and Conditions of Use retaining binding force between the Parties.
6.2 SQP reserves the right to unilaterally modify the terms of these Conditions.
The new clauses will govern all relations between the parties for the future, and only the new version will prevail between them.
6.3 These General Conditions of Use are governed by French law both for the substantive rules and for the rules of form.
In case of dispute, the parties agree to seek an amicable solution before seizing the competent jurisdiction.
